Are Real Estate Agents Obligated to Disclose a - Lawinfo Blog

A woman named Janet Milliken left California to start a new life in Pennsylvania. ?In June 2007, she purchased a house from Joseph and Kathleen Jacono for $610,000 to live in with her two teenage children.? All seemed well until a few weeks later when she discovered that her newly purchased home was the site of a murder-suicide that had occurred a year earlier.

According to a news source, Miliken wants the transaction rescinded.? She sued the Jacono?s and the real estate agent for fraud and misrepresentation, claiming that they intentionally failed to disclose the murder-suicide that took place in the home. ?Unfortunately for Miliken, the trail judge ruled against Miliken, stating that Pennsylvania law??does not require agents to disclose such events.? ?Miliken has not given up in her suit against the agent and seller.? Last week, she filed a petition to the Supreme Court of Pennsylvania.

What is Fraud?

Fraud?occurs when one intentionally deceives another.? It can be filed as either a civil or criminal claim.? Therefore, the fines for fraud can be monetary as well as punitive.

What Is Real Estate Law?

Real estate law?includes a wide variety of legal issues including real estate sale disputes such as breach of contract, specific performance, non-disclosure, fraud or misrepresentation.

Each state has its own set of?real estate laws. ?To learn more about real estate laws in your state, contact a real estate attorney?in your area today.

Would you buy a home where a murder-suicide took place?? Do you think sellers in all states should be required to disclose such events?

Debt limit extension bill passes House

WASHINGTON (Reuters) - The House of Representatives on Wednesday passed a Republican plan to allow the federal government to keep borrowing money through mid-May, clearing it for fast enactment after the top Senate Democrat and White House endorsed it.

The vote in the Republican-controlled House was 285-144, with no votes coming from 33 Republicans and 111 Democrats.

The measure avoids for the time being a repeat of the 2011 debt ceiling standoff that rattled markets and resulted in a downgrade of the government's triple-A credit rating. The Treasury is expected to exhaust remaining capacity under the $16.4 trillion debt limit between mid-February and early March.

The House vote marked a sharp departure from Republican vows to use the debt ceiling issue as a way to extract spending cuts from President Barack Obama.

But House Speaker John Boehner warned immediately after Wednesday's vote that Republicans would take the next opportunity - automatic budget cuts set for March - to demand "reforms" from Obama.

The automatic cuts, which were temporarily set aside earlier this month in a fiscal deal between the White House and Congress, are "going to go into effect" unless Obama makes concessions, Boehner said.

The bill aims to draw Senate Democrats into the debate by requiring both chambers to pass a formal budget resolution by April 15. If either the House or Senate fails to meet this deadline, lawmakers' pay is suspended until they pass a budget.

Republicans have named the bill the "No Budget, No Pay Act of 2013."

Senate Majority Leader Harry Reid said the Democratic-controlled Senate would take up the bill and pass it without changes. He and other top Senate Democrats praised the Republican plan for not requiring spending cuts to match the increase in borrowing authority.

Both Reid and President Barack Obama have called for a "clean" debt limit increase. The White House said on Tuesday that Obama would not stand in the way of the bill if it was passed by Congress.

"This proposal gives us something we can work with here in the Senate," added Senator Charles Schumer, a New York Democrat.

Republicans backed the bill in the face of polls showing Americans blaming them, rather than Democrats, for the uncertainty surrounding the so-called "fiscal cliff" that was resolved around New Year's Day by raising taxes on the wealthy.

House Democrats who voted against the bill complained that it was a politically motivated gimmick that created a new "fiscal cliff" in the spring.

BREATHING SPACE

The bill avoids an immediate threat of U.S. default by suspending limits on the government's ability to borrow until May 19. It does not specify a dollar amount for debt ceiling increase, but allows borrowing as needed to meet federal obligations that must be paid by that date.

Congress would then have to agree on a new, longer-term debt ceiling increase around that time - a deal that would not likely come without a more comprehensive deficit reduction plan.

Boehner, who unveiled the short term extension plan last week, said he and fellow House Republicans were committed to passing a budget that would be balanced in 10 years.

According to budget experts, achieving such a goal, especially in the absence of additional tax hikes, would require massive cuts in federal spending beyond any envisioned in previous Republican-backed budgets or in the deficit-reduction plans of panels such as the bi-partisan Bowles-Simpson commission on Fiscal Responsibility and Reform.

The government is currently on track for its fifth straight fiscal year with a deficit exceeding $1 trillion - a trajectory widely viewed as eventually leading to a debt downgrade.

"My goodness, we ought to be able to balance the budget over the next 10 years," Boehner said on the House floor.

House Budget Committee Chairman Paul Ryan, who was the Republican vice presidential nominee in the 2012 election, said the measure was aimed at prompting a robust debate in Congress over how to achieve a more sustainable fiscal path.

"We see this as a very defining moment for this session of Congress and our caucus on getting a down payment on the debt crisis, on averting it," Ryan said at a media breakfast sponsored by the Wall Street Journal.

But House Democrats objected, saying it was irresponsible to set short-term debt limit deadlines that would keep a cloud of uncertainty hanging over financial markets and cause volatility and higher interest rates.

"This legislation sets up another fiscal cliff, another financial nightmare, another problem for the American people that we should avoid," said Representative Rob Andrews, a Democrat from New Jersey.

Representative Sander Levin, the senior Democrat on the tax-writing Ways and Means Committee, told reporters: "We should not continue to have this sword of default over the heads of Congress and the American economy."

SEQUESTER SHOWDOWN

The vote shifted the budget debate to the March 1 start of automatic spending cuts for military and domestic programs, and the March 27 expiration of funding needed to keep federal agencies operating.

Ryan said he believed that the automatic cuts, known as a sequester, would likely proceed without changes, because no alternatives have been advanced by Senate Democrats or the Obama administration.

The House last year passed two bills to replace the sequester cuts for fiscal 2013, sparing any reductions for military programs, while shifting more of the cuts onto many domestic programs aimed at aiding the poor, including the Medicaid healthcare program and social services block grants.

After the "fiscal cliff" deal, signed by Obama on January 2, raised taxes on the wealthy and delayed the start of automatic cuts, Congress faces about $85 billion in cuts for the remainder of fiscal 2013, which ends on April 14.

The budget plans that the legislation aims to enforce would set discretionary spending levels for fiscal 2014, which starts on October 1.

Neural Networking: Online Social Content Easier to Recall Than Printed Info

Call it the Facebook Effect?humans are better at remembering information if it appears as a social network post

Image: Katie Sayer/Flickr

?

Recollecting trivial and sometimes dull Facebook posts is easier than recalling the same information in a book. It also takes less effort to remember posted patter than someone's face, according to new research.

The result could be due to the colloquial and largely spontaneous nature of Facebook posts. Whereas books and newspapers typically are combed over by fact-checkers and carefully rewritten by editors, Facebook posts tend to be free flowing and more closely resemble speech. "It's a new way of thinking about memory," says John Wixted, an experimental psychologist at the University of California, San Diego, who was not involved in the research. "Our minds are naturally prepared to encode what is naturally produced."

If memories are the product of evolution, then the ability to remember socially derived conversations may have provided an advantage that helped early humans survive, he adds.

The study involved three different experiments with a sample that largely included undergraduate females and controlled for such factors as the use of emoticons, variations in character size and emotional content. What the research team found didn't make sense?at first.

Laura Mickes, a cognitive psychologist at U.C. San Diego and lead author of the study, says colleagues in her department were amazed by the consistency of the results. "To our surprise the microblogs, the Facebook posts, are much more memorable than one would expect," Mickes says. "People mostly think they're mundane and would be easily forgotten."

Even accounting for associative thinking?such as, "that is something my friend Emily would post"?the social networking site still had a pronounced effect on the extent to which information was remembered by study subjects. Facebook's advantage over books and faces is on the same scale as the advantage that the average person has over the memory-impaired, Mickes wrote in the January 2013 Memory & Cognition. Both Mickes and Wixted agree that additional experiments are needed before these findings can be applied broadly, largely due to the lack of diversity among the study subjects.

Still, the implications are profound. Marketing firms could use Facebook-like advertisements to increase brand recognition. Teachers, too, might incorporate shorter, more colloquial sentences on study guides and in textbooks to raise test scores. The applications could be extensive: "I think there are implications for the way we teach, for how we advertise, how we generally communicate," Mickes says. "There are already professors who are into tech who have incorporated social media into their classrooms."

According to the study, Facebook users in total post more than 30 million times per hour. Whether it?s easier on the brain, that's a lot to remember.

Biometrics using internal body parts: Knobbly knees in competition with fingerprints

Jan. 23, 2013 ? Forget digital fingerprints, iris recognition and voice identification, the next big thing in biometrics could be your knobbly knees. Just as a fingerprints and other body parts are unique to us as individuals and so can be used to prove who we are, so too are our kneecaps. Computer scientist Lior Shamir of Lawrence Technological University in Southfield, Michigan, has now demonstrated how a knee scan could be used to single us out.

The approach based on MRI could be used to quickly register and identify people in a moving queue as they approach passport control at airports for instance or as they walk through the entrance to an office block or other building.

Shamir has tested the approach and achieved accuracy of around 93 percent, this coupled with other factors such as possession of the correct passport, being in the right place at the right time or tied to other biometrics such as iris recognition and signature analysis could be used to prevent deception and fraud. Contact lenses can be used to dupe iris recognition systems, passports can be forged.

"Deceptive manipulation requires an invasive and complicated medical procedure, and therefore it is more resistant to spoofing compared to methods such as face, fingerprints, or iris," Shamir points out. It would be almost impossible to fake one's internal body parts including the kneecaps. Of course, kneecaps are a renowned target of irreversible and deleterious adjustment in the criminal world, but even then shattered kneecaps are likely to be unique to the victim in any case.

MRI scanning avoids health risk of scanning with ionizing radiation, such as X-rays, it would also avoid some of the privacy issues that have arisen with terahertz scanners that can "see" beneath a person's clothing, whereas MRI goes more than skin deep. There is a distinct problem with the implementation of MRI scanning in a security setting in that MRI scanners are very large machines and take a long time to acquire an image of even a small body part such as the kneecap. However, developments in MRI technology are fast moving and it is likely that within the medium term more portable and faster equipment will emerge that could fulfill the security role.

"Further studies will develop the concept of internal biometrics, and will lead to automatic identification methods that are highly resistant to spoofing," concludes Shamir.

Grizzlies win 106-93, Lakers lose 4th straight

MEMPHIS, Tenn. (AP) ? A team meeting didn't help stop the losing, and this season just keeps spinning away from the Lakers.

Darrell Arthur scored a season-high 20 points and Mike Conley added 19 as the Memphis Grizzlies beat Los Angeles 106-93 Wednesday night, handing the Lakers their fourth straight loss and 10th in 12 games.

"I do think they play as hard as they can play, and that's what's scary," coach Mike D'Antoni said of his Lakers, who are now 2-10 in January. "I mean I don't know how we can play harder or blame something else. We just didn't play well."

Kobe Bryant said he felt comfortable with what he said in a team meeting before the morning shootaround. He said he doesn't know if his message to Dwight Howard got across. When asked if he hoped it did, Bryant simply answered with a seemingly sarcastic "No." And Bryant said this season certainly is getting up there when asked if it was his toughest in the NBA.

"That Rudy T (Tomjanovich) one was a pretty hard one, too," Bryant said.

That was 2004-05, when the Lakers last missed the playoffs when Tomjanovich was coach part of a 34-48 season.

These Lakers are 17-25 after losing their seventh consecutive road game. D'Antoni had talked before the game about having an All-Star team with players not having learned their pecking order. Then Howard missed the second half after aggravating his sore shoulder just before halftime. D'Antoni said the center will be re-evaluated in Los Angeles.

Memphis got to celebrate a big win, a day after trading three reserves to Cleveland. That meant, even with the signing of D-League player Chris Johnson, Memphis only dressed 10 players before clinching the season series over the Lakers with one game left in Los Angeles on April 5.

"It was just a great team win," Memphis coach Lionel Hollins said.

Rudy Gay, Zach Randolph and Tony Allen added 12 points apiece as Memphis improved to 12-0 when scoring at least 100 points. Randolph also grabbed 10 rebounds. The Grizzlies scored a season-high 60 points in the paint, compared to 34 for the Lakers with Howard out the second half.

Bryant scored 29 points for the Lakers, Metta World Peace added 15, Pau Gasol 13 and Earl Clark 11.

Los Angeles came in as the NBA's fifth-best scoring team, averaging 102.6 points. But it was the Grizzlies topping 100 points for the first time since Jan. 11 against the Spurs, and they scored their most points since getting 113 against Sacramento on Jan. 7.

Pau Gasol, coming off the bench again, believes defense remains the Lakers' biggest problem.

"We make these teams look a lot better offensively than they really are," the Lakers forward said. "That's something that's pretty negative. Pretty alarming."

The Grizzlies had a short bench after trading three players to the Cavaliers on Tuesday, only getting Jon Leuer back in a move freeing up Memphis from the luxury tax. But the paperwork hadn't cleared on the physicals of the trio going to Cleveland in time to have Leuer available against the Lakers.

Then Marc Gasol, Randolph, Hamed Haddadi and Jerryd Bayless all picked up two fouls each in the first quarter. That forced Hollins to rotate his Grizzlies to keep them fresh, and rookie Tony Wroten, who has gotten most of his playing time in the D-League in Reno this season, had a career-best nine points by halftime.

"When we are faced with adversity, we show that we can win," Allen said. "When adversity comes, when guys get hurt, we pull together."

The Lakers started quickly, scoring the first six points of the game and forced four turnovers. They looked like they had listened to D'Antoni's plea for better defense.

But they last led 30-28 on a 15-footer by Pau Gasol with 9 minutes left in the second quarter. Conley answered with a 9-foot runner to tie it up, and that started a 22-5 run as the Grizzlies took the lead for good. Conley capped the spurt with a fast-break layup with 4:25 left in the first half for a 50-35 lead.

Both teams shot better than 50 percent in the first half, but the Grizzlies led 59-50 at halftime. They led by as much as 21 in the second half and finished with a 27-3 edge on second-chance points. They outrebounded the Lakers 52-34, including 16 offensive rebounds.

"It's just the same thing over again," Lakers forward Earl Clark said. "We broke down defensively. They went on a run, and we continue to just go downhill."

Meanwhile, Howard was 0 of 4 from the floor and headed to the locker room with 2:21 left in the first half, flexing his right shoulder. He had been probable with a torn labrum and had a very physical first half against Gasol and Haddadi.

The Lakers got within 61-58 on a 14-footer by Bryant with 8:57 left in the third. That was as close as they would get as their woes worsened when Steve Nash, who came in a perfect 26 of 26 at the free throw line this season, missed his second attempt of the night with 3:07 left in the third.

Notes: Gay tied Pau Gasol as the Grizzlies' franchise leader in games played with 476 ... D'Antoni, told at least he didn't have to worry about coaching the All-Star game this season, joked, "just barely missed it by 30 games." ... Memphis had gone six straight games since last topping 100 points, and the Grizzlies needed overtime to do that against the Spurs. ... Memphis had a 43-29 scoring edge from the bench. ... Nash finished with eight assists but six turnovers.

Student gets dying wish from Reddit: Cryonic preservation

1 hr.

?

Kim Suozzi, a 23-year-old neuroscience student with terminal brain cancer, received her dying wish of cryonic preservation on Jan. 17 after a successful fundraising campaign launched on the internet.

Cryonic preservation freezes legally-dead people to liquid nitrogen temperature to stop physical decay. People undergo it in the hope that future technology will exist to revive their bodies and restore them to good health.?

Suozzi announced her desire for cryonic preservation on Reddit, a social media website, in August 2012 after learning she had less than a year to live.?

?I?ve been interested in cryonics since long before I was even diagnosed, but I never thought that I would have to secure the finances so fast, and without a career or savings to stand on,? she wrote.

The procedure runs anywhere between $28,000 and $200,000 depending on the options chosen, according to io9.?

Suozzi?s request was picked up by the Society for Venturism, a non-profit futurist group that advocates cryogenics.?

The combined fundraising efforts succeeded and Suozzi went into cryosuspension at the Alcor Life Extension Foundation in Scottsdale, Ariz., on Jan. 17, the society announced.

The likelihood of a?person coming back to life using current freezing techniques is nil, Arthur Caplan, director of the Center for Bioethics at the University of Pennsylvania, told NBC News, especially given the vulnerability of cells to frosting and defrosting.

?It wouldn?t take a lot of damage to shift somebody from being a reconstituted person to being a reconstituted vegetable,? he said. ?You don?t need that much cell damage to cause harm.?

Even if a person were successfully restored, ?you?re going to be kind of a freak,? Caplan added.?

For one, in century or two, a person is unlikely to harbor immunity to flu or other diseases of the time and could easily get sick and?die upon first contact. Caplan likened the effect to the devastating spread of disease among Native Americans upon first contact with Europeans.

?Socially you are facing trouble because you are going to be this weird object of curiosity,? Caplan added. ?Friends are gone. No one is there. I would worry you quickly become isolated and depressed.?

Despite the unlikelihood of success and weird reality a person would wake to if cryonic preservation did indeed work, Caplan said people will still likely spend hundreds of thousands of dollars giving it shot.

?I think it is a ripoff,? he said. ?The dream of immortality is powerful, but I think it?s just a pipe dream.?

Suozzi was aware of the controversy and doubts surrounding cryonic preservation, but pursued it nevertheless. ?It?s a better shot at living again than if I were decomposing somewhere or cooked into ash,? she wrote.?

Marshall Elder and Estate Planning Blog: Getting Care at Home ...

As I get older I find that there are many fine attributes of aging. (Personally, I think wisdom is one of them - though my children seem to disagree).? Unfortunately, aging also increases our risk of frailty and illness and advances the potential that we may someday need the assistance of others to help us be able to remain at home.

Most seniors who need help with their daily care needs are able to live at home, either in their own home or that of a close relative. Their care needs are most often met through the unpaid help of family members. An estimated 16 percent of American adults, or 33.9 million adult caregivers, provide unpaid care to a recipient age 50 and older. (National Alliance for Caregiving Report, Caregiving in the United States). According to a 2011 survey by the National Caregivers Association, more than two-thirds of caregivers are 45-64 years of age, nearly one-half have household incomes less than $40,000 and about one-third are employed full time. A typical caregiver is a married woman in her mid-forties, who provides 20 hours of care-giving per week, often while working full-time.

Despite the love, sacrifice and often heroic efforts of family, there may come a time when a care recipient?s needs overwhelm the unpaid family caregivers. The family may have to look to supplement the care it can provide with paid assistance.?

A family seeking paid in-home help to care for Mom or Dad faces a complicated array of issues and options.? Where do you start?? How can you find quality help?? How are you going to pay for it?

Assessing Needs

An early step should be to assess the situations of the senior and the family caregivers, and create a realistic plan. You may wish to seek the advice of the care recipient?s physician, and seek help from your local Area Agency on Aging (AAA). The government-funded AAAs will provide a care manager at no charge to assess the senior?s needs and help create a plan to provide in-home services. A listing of Pennsylvania AAAs by county is available here and at the Department of Aging website: www.aging.state.pa.us. If the care recipient is being discharged from a hospital, limited discharge planning assistance should be available from the facility. In some localities, a private geriatric care manager (GCM) can be hired to help assess an older individual?s needs, create a care plan, and locate the assistance required to implement the plan.? Unfortunately, GCMs may be unavailable in more rural areas.

Finding caregiving services that are suited to your needs is complicated and requires thought and research. You can start by making a listing of which types of services will be needed. In searching for home care providers consider the level and quality of care they can provide, their availability and ability to provide the services you need, their training and experience, and how to pay for the care.

Finding Paid Caregivers

Once you have assessed needs and created a plan, the next step is to locate individuals and companies who can fill those needs. In some cases you will need to decide whether to try to hire help yourself or go through an agency.?

The main advantage of handling this task yourself is that privately hired caregivers are usually less expensive.? And you have the flexibility to hire family members or friends who are already known by the senior. But if you hire the home care worker yourself, you are responsible for the burden of dealing with employment rules and taxes. In some cases families choose to pay caregivers illegally ?under the table.? This is not recommended. ?

If you need help in locating paid caregivers, you may turn to either a home care registry or a home care agency. Both home care registries and home care agencies help supply families with paid caregivers who care provide ?unskilled? assistance with needs such as:

  • Assistance with self-administered medications

  • Personal care such as assistance with personal hygiene, dressing, and feeding

  • Homemaking such as assistance with household tasks, housekeeping, shopping, meal planning and preparation, and transportation

  • Providing a respite for unpaid family caregivers
??

Registries are a kind of ?matchmaker? that provide a list of names of people interested in providing home care services. The registry is typically paid a fee for its services but does not employ or supervise the worker. Those responsibilities remain with the family.? If you use a registry it is important to note that the workers you hire are subject to employment taxes for which you are responsible.? You may need an accountant?s help to set up your books.?

Home Care Agencies differ from registries in that agencies directly employ the care workers. This can free the family from bookkeeping and tax responsibilities and generally makes life easier for the family. Agencies handle all of the paperwork involving payroll and related taxes. The agency will find the workers, screen them, and monitor their work. If an agency offers a full range of services, the care may be better coordinated and more comprehensive. An individual care worker?s sudden unavailability can be better managed, since the agency can fill the gap.

Although the names are confusingly similar, Home Health Care Agencies (also known merely as ?Home Health Agencies?) are different from home care registries and home care agencies. A Home health agency can deliver skilled care like nursing, physical therapy, and occupational and speech therapy, along with unskilled assistance. Importantly, Medicare, Medicaid, and your private insurance plans may pay for services that are provided by a licensed home health agency. Payment will depend on whether the care is medically necessary and you meet qualification criteria. You may opt to pay out-of-pocket for services that are not covered by other sources.? Your local Area Agency on Aging (AAA) may also be able to help the family locate and retain the services of paid caregivers.? Find a list of Pennsylvania AAAs here.

Paying for Care ???

Seniors needing home care assistance can use private funds to pay for the care. Some commercial insurance policies may help with the cost of care. Some specialized ?long term care insurance? policies specifically designed to pay for long term care may cover some home care costs.? But few seniors currently own this type of policy.?

Reverse mortgages may also provide a funding source for private payment of home care. A "reverse" mortgage is a loan against your home that you do not have to pay back for as long as you live there.

There are many publicly funded programs that may also help families pay for needed care.

Medicare ? This program has some home health care coverage which can be of importance to seniors who require skilled care at home. Home health agencies are very familiar with Medicare and can help the senior qualify for any available benefits. The recipient must be homebound and require skilled care which is ordered by a physician. The official U.S. government booklet about Medicare home health care benefits for people with Original Medicare is available here.? Medicaid ? Medicaid is an increasingly important source of payment for home care for seniors. In addition to the services provided under regular Medicaid, Pennsylvania?s Aging Waiver program can provide home care to individuals over age 60 who would otherwise require institutional care in a nursing facility.? For those who qualify, there are no co-payments. Your AAA will have information available about the Aging Waiver and an elder law attorney may be able to help seniors qualify for Medicaid Aging Waiver benefits.? Veteran?s Benefits ? Unfortunately, these benefits are often overlooked. Older veterans (and the spouses of deceased veterans) may qualify for VA pension benefits even though they don?t have a service connected disability.? Benefits are increased if the veteran is homebound or in need of the aid and attendance of another person. Office of Aging ? several additional programs like Pennsylvania?s Caregiver Support program are operated through your local AAA.? A combination of unpaid family care supplemented by privately or publicly paid services can allow a frail senior to remain in the home for as long as possible.? Publicly funded programs often have financial qualification limitations.? A knowledgeable elder law attorney can often help the senior find out about programs and meet qualification requirements.???

Hostess Union Hires Investment Bank To Represent Workers As Company Sells Off Iconic Brands

NEW YORK -- The pension fund for one of Hostess Brands' unions has hired an investment bank to represent workers and pensioners as the maker of Twinkies and Wonder Bread sells off its brands.

In a statement posted Sunday on its website, the Bakery, Confectionery, Tobacco Workers and Grain Millers International Union, which represents around 6,000 Hostess bakers, said Gordian Group LLC will represent the fund.

Gordian, a New York investment banking firm that specializes in distressed cases, has represented unionized workers at American Airlines, which is undergoing restructuring in bankruptcy. It's also an adviser in the ongoing liquidation of disgraced investor Bernard Madoff's firm.

Earlier this month, Irving, Texas-based Hostess selected Flowers Foods Inc. to buy its six bread brands, including Wonder Bread, along with 20 bakeries and 38 depots, for $390 million.

Flowers Foods, based in Thomasville, Ga., was selected as the stalking horse bidder for the bread brands. That means higher competing bids can still be made and the final deal must be approved in bankruptcy court.

Hostess is expected to find buyers for its dessert cakes, which include its iconic Twinkies and Ding Dongs, along with the Drake's Cakes and Dolly Madison brands, in the coming weeks.

Gordian President Peter Kaufman said his company will try to ensure that potential buyers hire former Hostess workers and honor Hostess' pension obligations.

"Given the sale process that is under way, we believe the bakers working with a buyer create the opportunity to increase value and are pivotal to the success of the business," Kaufman said in a statement. "Buyers should know that the Bakers are very interested in having direct discussions with them."

The Bakery and Confectionery Union and Industry International Pension Fund pays out $42 million in benefits per month to 52,000 pensioners, according to its website.

Hostess filed for bankruptcy protection in January 2012 after years of management turmoil and turnover. A bankruptcy judge approved its plan to liquidate its assets in November after it failed to reach a new contract agreement with the bakers' union.

Activists: Airstrike kills at least 7 near Syrian capital

BEIRUT (AP) ? Syrian government troops battled rebels in several areas outside Damascus on Sunday while regime warplanes bombed opposition-held areas around the capital, including an airstrike on one village that killed at least seven people, activists said.

Rebels seeking to topple President Bashar Assad have seized swaths of territory in northern Syria but have become bogged down in their push for Damascus, where government troops are still firmly in control. While the opposition fighters have established footholds in suburbs east and south of the capital, Assad's forces have kept them from advancing into the heart of the city and regularly hit them with artillery and airstrikes.

Much of the fighting Sunday was focused in areas east and south of the city, the Britain-based Syrian Observatory for Human Rights said, while government jets were bombing rebel areas.

An airstrike on the village of al-Barika, southeast of the capital, killed at least seven people, including five members of the same family, the Observatory said. Other activists provided the names of the dead, including the mother and father of the Shehadeh family and three of their children.

A video posted online said to be from the site showed dead bodies in the back of a pickup a truck and body parts and blood scattered in the street. "A whole family," an off-camera voice says, adding that they had fled to the village to escape violence elsewhere.

Another video posted online showed what activists said was the aftermath of an airstrike on the central village of Kafr Aya.

The video showed more than 10 wounded people being treated in a rudimentary field hospital. Some the wounded were children and appeared to be unconscious. A small baby was wrapped in a bloody white blanket with a badly wounded forehead.

The videos appeared genuine and corresponded to other activist reports.

The Syrian government does not respond to requests for comment on military actions.

The state news agency said Sunday that troops had killed "scores of terrorists" in two rebellious southern suburbs of Damascus. The government considers the rebels and its other internal opponents "terrorists" backed by foreign powers that seek to destroy Syria.

Also Sunday, the Observatory distributed two videos showing a rebel beating a captured government soldier with a rope.

The captive had been stripped to his underwear and was forced to raise his arms so he could be beaten on his sides, lifting his feet to receive blows on their soles.

At one point, a captor asked: "Who is your God?" To which the captive replies: "God." The captor then says: "No. Your God is Bashar Assad."

The Observatory's head, Rami Abdul-Rahman, said the videos were from the Jabal al-Zawiya region of Syria's northwestern Idlib province, though he did not know which of the area's rebel brigades filmed them.

Syria's government has been accused of war crimes throughout the conflict and at least 56 countries have co-signed a petition calling on the U.N. Security Council to refer the issue to the International Criminal Court. The Council, however, remains split.

Accusations of war crimes by rebels have grown increasingly common, and Abdul-Rahman said he had more than 70 videos of rebels torturing people and more than 20 of them killing captives.

Abdul-Rahman, who supports the rebels, said he opposes such actions by either side.

"We are dreaming of a new Syria and a new democratic country," he said, "We don't want a system where if someone kills me I can kill him."

Syria's crisis began in March 2011 with protests calling for political reform that the government quickly repressed. It has since evolved into a civil war with scores of largely independent rebel groups fighting the government across the country.

The U.N. said this month that more than 60,000 people had been killed since the conflict's start.

Is it Wise to Rely on Internet Marketing Software to Do SEO for You?

Internet marketing software program is among the most lucrative companies on-line, and veteran entrepreneurs know it. ?It's commonplace for the veteran marketer to see a good idea by anyone else, commission a freelance programmer to recreate it, after which promote it and put it up for sale in a more savvy approach than the competitor. ?

When all is claimed and done, a new 'will must have' piece of internet marketing software can go from scratch to market release inside a few weeks, and the target audience is almost definitely the internet advertising and marketing newbie. ? ?The truth is that the internet marketing software simply is not a requirement by newcomers to web marketing. ?

?

The difficulty with web advertising and marketing is that there is a vicious cycle at work. ?The experts will make a copycat software product and launch it quickly. ?They will current it with a killer sales letter. ?They will market to the newbie?s who will see it, get attracted to it, and absolutely really feel they cannot be without it. ?The newbie?s purchase the software and sometimes find they do not know the finest manner to use it efficiently. ?They then ask expert marketers how they will become profitable and, shockingly, swept away with the brush of a hand. ?

?

After all, this does not apply to all veteran marketers. ?Many are helpful. ?However, it is vital to understand how the cycle works so you will not suck into the whirlpool of despair. ?Remember that if you are a newcomer, you really need little or no money to get started. ?Indeed, you should be encouraged to earn your first pay checks with almost zero start-up cash. ?That is completely one of one of the best ways to learn online, and you will quickly learn there may be absolutely no need for web advertising software. ?

?

Once more, that's not to say internet advertising software program is ineffective - most of it does automate sure aspects of your corporation and makes you a more environment friendly employee overall. ?However, do not feel you want web advertising and marketing software program to make money. ?All it takes is an inventive mind, an understanding of affiliate marketing, and a free blogs. ? ?

?

If anything, buying expensive "must have" internet advertising software will solely stifle your daring attempts to make money online. ?There is none internet marketing software obtainable that acts as a computerized cash machine. ?

?

Internet advertising and marketing software program focused strongly, and can solely automate a small proportion of one?s business. ?It is the equivalent of getting a satellite navigation system inside your car as a substitute of utilizing a map; sure, it may make your journey simpler and more efficient in a single side, but it surely certainly is not required for navigation and it positively is not required to drive the car. ?So do bear that in mind. ? ?

?

"Get One Million Guests to Your Web site" and "Construct a 100,000 Member Opt-In List in Days" were just a few the plethora of untamed claims that sucked you in. ?Some would lead you to believe that it was a foregone conclusion that you might have an extremely profitable online business just by investing in a handful of Internet advertising software.

?

Once more, it is wise to set up a software program for your business needs, considering the amount of software accessible online. ?You must think at all times about discovering your software by means of Google or any main search engine. ?The entire time searching for the?internet marketing software?evaluations and its optimistic or detrimental aspects would facilitate the building of your internet marketing strategies in the process. ?You want to search for these in different websites and never in the supply website. ?You need to learn also through the testimonials supplied by software providers. ?Once you completed the task, get your full model, it should make your life easier. ?
